We want to start this with the story of a woman who is riding in an Uber in March of 2018. Jillian Kemenosh was halfway through with a four-mile Uber trip from Columbus Boulevard to her apartment in Center City. This matter may be getting a second look after a Philadelphia Common Pleas judge wrote that “the registration process did not properly communicate an offer to arbitrate under Pennsylvania law.” The judge noted that Uber does not force users to click a hyperlink to review the company’s terms of service, thereby making it possible for users to never understand what rights they are giving up in the event an accident occurs.
While there are no solid statistics on how many accidents involve Uber vehicles, we do know that these incidents often cause severe injuries. Uber does provide a $1 million liability insurance policy that kicks in when a rideshare driver has a passenger or is on the way to get one.
