Our wrongful death attorneys at Dan Doyle Law Group want to inform that death any age is traumatic for the family members. Just because your grandmother of 90 passes away due to negligence does not mean that her death does not matter any less than a younger person’s death. Life is life. Our wrongful death attorneys understand that if your loved one died due to the negligence of someone or some party then justice must be served.
Nursing Homes Aren’t Reported
What happened to respecting our elders? Not only respecting, but taking the time to take care of them? Not every elderly person has a loving home or loving family members. Some have to depend on strangers to help keep them going. After any major surgery or injury, the elderly may end up in a nursing home where they are well taken care of by the medically trained staff. Or so the brochure says. Unfortunately, the brochure lies.
Even though nursing homes are supposed to report every death, they are not legally obligated to unless the death falls into one of three categories:
- The death is due to medication error
- The death is due to injury, suicide, or an unusual circumstance
- The death is due to malnutrition, sepsis, or dehydration
Upon taking a closer look at these categories, one can see that if the nursing home reported under one of these categories they would be admitting to negligent care at their facility. A fine would be administered and the home would have to pay the fine. Self-reporting with a fine is not an incentive, to tell the truth.
Dr. Batta’s Story
The family of the late Dr. Batta, an anesthesiologist, has filed a wrongful death lawsuit against Manor Care’s Wallingford Nursing home. They have strong evidence that Dr. Batta’s death was due to the facility’s negligence.
Dr. Batta was sent to the nursing home to recover from surgery. The surgery was not traumatic, but he would need 24-hour care just in case. A week late Dr. Batta died due to an “obstructed tracheostomy tube”. This kind of incident should have been monitored as it is very common in Dr. Batta’s situation. The family is distraught about the loss of their father but even more so about the negligence of the facility. If their father were to die from something so easy to look out for then who else has been neglected?
