Even though nursing homes are supposed to report every death, they are not legally obligated to unless the death falls into one of three categories:

  • The death is due to medication error
  • The death is due to injury, suicide, or an unusual circumstance
  • The death is due to malnutrition, sepsis, or dehydration

Upon taking a closer look at these categories, one can see that if the nursing home reported under one of these categories they would be admitting to negligent care at their facility. A fine would be administered and the home would have to pay the fine. Self-reporting with a fine is not an incentive, to tell the truth.

Dr. Batta’s Story

The family of the late Dr. Batta, an anesthesiologist, has filed a wrongful death lawsuit against Manor Care’s Wallingford Nursing home. They have strong evidence that Dr. Batta’s death was due to the facility’s negligence.

Dr. Batta was sent to the nursing home to recover from surgery. The surgery was not traumatic, but he would need 24-hour care just in case.
